Rabiya Khan missing from daughter Jiah Khan’s hearing

Jiah Khan committed suicide in 2013, but her case is yet to be resolved. Her then boyfriend, actor Sooraj Pancholi has been charged with ‘Abetment of Suicide’ under Section 306 of the Indian Penal Code, which he has pleaded not guilty to. The hearing started on Wednesday, and while Pancholi was in attendance, Khan’s mother Rabiya, who has been fighting for justice for her late daughter, was not.

DNA reports that Pancholi’s lawyer had asked the court to send an summons to Rabiya, which was agreed upon, but the prosecution had also not filed a list of their witnesses, as they were also not present at the hearing. The court has asked the prosecution to file their witnesses by 21st February, which will also be the next hearing date. Rabiya will have to attend the second hearing or there will be a bailable warrant issued, and if she is not in attendance again, an non-bailable warrant will be issued, to bring her into court.

Pancholi’s lawyer Prashant Patil said, “My client has requested the Hon’ble Court to issue summons to the Complainant as the charges in the said matter are framed and now the matter is kept for evidence of witnesses. However, as the list of witnesses was not filed by the prosecution hence, the Hon’ble Court has directed the prosecution to file the list of witnesses in the said matter. Meanwhile, the Complainant’s lawyer made certain submissions, which were objected by us as the Complainant has no locus to address the Hon’ble Court directly even according to the orders passed previously. I have filed a pursis to that effect that in spite of specific orders passed by the Hon’ble Court, the Complainants lawyer is directly addressing the Court and has thus committed contempt of Court orders.”

Pancholi has maintained his innocence in the case.
